Synopsis "Ideologia no Supremo Tribuna Federal (in Portuguese)"

A literatura sobre o judicial behavior aponta basicamente dois modelos explicativos para o comportamento decisório dos magistrados, em especial na Corte Constitucional. De um lado, o modelo atitudinal, que preconiza que as decis µes judicias s úo orientadas principalmente pelas prefer ªncias políticas (ideologia) dos magistrados e, de outro, o modelo legalista, que sustenta que os magistrados proferem seus votos essencialmente com base em argumentos jurídicos. Este trabalho tem como questionamento central verificar empiricamente se as prefer ªncias políticas dos ministros do STF e/ou seus argumentos eminentemente jurídicos podem explicar suas decis µes, utilizando como campo de observa § úo os casos de Repercuss úo Geral (RG) na área tributária no período 2007-2018.
