Sobre ambas orillas del Atlántico se está imponiendo una narración común de las vicisitudes políticas y constitucionales del último medio siglo. Luego del final de la Segunda Guerra Mundial, se sabe, muchos sistemas iuspolíticos occidentales adoptaronconstituciones rígidas y tribunales o cortes constitucionales: no obstante, este es solo el comienzo de la historia. Los mismos sistemas, se dice, sufrirían profundos procesos de constitucionalización; en otros términos, los valores éticos de dignidad humana, libertad, solidaridad y similares, formulados en las declaraciones de los derechos e invocados sistemáticamente por jueces constitucionales y ordinarios, se estarían irradiando por todo el derecho. Dicho, incluso, de manera distinta, cada uno de estos sistemas iuspolíticos se estaría transformando de Estado (de derecho) legislativo (en alemán: Gesetzsstaat) en Estado (de derecho) constitucional (en alemán: Verfassungsstaat).
